1. Identity of the owner

Itinerama is a mobile application operated by Jonathan Rodriguez Ruiz, a self-employed professional established in Ireland.

In these Terms, “Itinerama,” “we,” “our,” or “the App” refers to the owner identified above.

2. Acceptance of the terms

These Terms of Use govern access to, download of, and use of the Itinerama application.

By downloading, installing, accessing, or using the App, the user agrees to be bound by these Terms. If the user does not agree, they must not use the App.

The use of certain features or third-party services integrated into the App may also be subject to additional terms, conditions, or policies from those third parties.

3. Description of the service

Itinerama is an application focused on travel planning, organization, and exploration. Among other features, it may allow users to:

• discover places of interest and activities
• view maps, routes, and navigation
• save favorites, routes, and preferences
• track travel expenses
• use artificial intelligence-assisted features
• consult contextual information such as weather data
• access third-party information and links related to activities or tourism services

Some features may depend on the country, device, app version, or the availability of third-party services.

4. Access and user account

The App allows certain features without registration through anonymous access, while other features may require a user account.

At present, Itinerama may allow access through:

• Sign in with Apple
• Google sign-in
• anonymous access

When the user creates or uses an account, they agree to provide reasonably accurate information and keep their details updated whenever possible.

The user is responsible for keeping their credentials confidential and for activities carried out through their account, except where unauthorized use is not attributable to the user.

5. Permitted use

The user agrees to use Itinerama only for lawful purposes, in accordance with these Terms and in good faith.

Among other things, the following are prohibited:

• using the App for illegal, fraudulent, or misleading activities
• accessing or attempting to access systems, accounts, networks, APIs, or data without authorization
• interfering with, damaging, or compromising the security, integrity, or availability of the App
• using bots, scrapers, or automated systems to extract data or exploit the service without authorization
• copying, reproducing, distributing, sublicensing, or exploiting content or software from the App without authorization
• using the App abusively or to the detriment of other users, third parties, or the owner

6. Purchases, subscriptions, and virtual currency

The App may offer:

• weekly subscriptions
• monthly subscriptions
• annual subscriptions
• one-time purchases of virtual currency packs called iticoins

In-app purchases and subscriptions are processed through Apple and may be technically managed through third-party providers used for subscription management and purchase restoration.

Payments, renewals, cancellations, restorations, and any refunds are subject to Apple and App Store terms.

iticoins:

• allow access to certain features of the App, such as assistant questions
• have no monetary value outside the App
• are not transferable between users
• are not refundable except where required by applicable law or Apple
• may be subject to internal rules on use, modification, or withdrawal for technical, operational, legal, or anti-fraud reasons

Subscriptions may remove certain native ads, although optional rewarded ads may still remain available to users who choose to watch them voluntarily.

7. Advertising

The App may display third-party advertising, including native ads and rewarded ads.

Rewarded ads are optional and voluntarily viewing them may generate in-app rewards in accordance with the rules in force at that time.

Itinerama does not guarantee the content, accuracy, availability, or safety of products, services, or advertising messages displayed by third parties.

8. Artificial intelligence and automation

Some Itinerama features use artificial intelligence systems or automated processing to generate responses, suggestions, or interpretations of information entered by the user.

These features may be used, among other purposes, to:

• answer user queries
• generate travel-related content or recommendations
• interpret information entered through OCR

Automatically generated responses or outputs may be incomplete, inaccurate, outdated, or unsuitable for all contexts. Users must verify any information before making personal, financial, travel, medical, legal, or other important decisions.

Itinerama does not provide professional advice and does not guarantee that AI-generated information is accurate, complete, or fit for a particular purpose.

9. Travel information, maps, and third-party services

The App provides planning and reference tools, but does not act as a travel agency, tour operator, or direct provider of tourism activities, except for its own in-app purchases.

Information displayed in the App, including places, schedules, prices, availability, weather, maps, routes, activities, or descriptions, may come from third parties and may change without notice.

Accordingly, Itinerama does not guarantee:

• the actual availability of activities or venues
• the ongoing accuracy of prices, schedules, or conditions
• the continuity or accuracy of maps, routes, or estimated times
• the accuracy of third-party content
• the suitability of results generated through artificial intelligence

When the user wishes to purchase third-party activities, products, or services, they may be redirected outside the App. Any contractual relationship arising from those purchases or bookings will be between the user and the relevant third party.

10. Intellectual property

All intellectual and industrial property rights in the App, its design, structure, software, logos, texts, interfaces, features, and other elements belong to Itinerama or its licensors, except for content that belongs to third parties.

Use of the App does not imply the transfer of any rights over those elements, beyond a limited, revocable, non-exclusive, non-transferable license for personal use in accordance with these Terms.

11. Third-party content and licenses

The App may include or display content, data, or references from third parties, including mapping services, information providers, tourism platforms, Wikipedia, Wikimedia Commons, OpenStreetMap, or other integrated services.

The user acknowledges that such content may be subject to specific licenses, terms of use, and attribution requirements established by their respective owners.

12. Suspension and termination

Itinerama may suspend, restrict, or terminate access to the App, in whole or in part, if:

• the user breaches these Terms
• abusive, fraudulent, or unlawful use is detected
• this is necessary for technical, operational, or security reasons
• there is a legal obligation or valid request from a competent authority

The user may stop using the App at any time and, if they have an account, may request or complete its deletion through the features available in the App.

13. Service availability

The App is provided “as is” and “as available.”

Itinerama does not guarantee that the App will be available at all times, uninterrupted, free from errors or incidents, or that all of its features will remain unchanged.

We may modify, update, suspend, or withdraw App features for technical, commercial, or legal reasons.

14. Disclaimer of warranties

To the fullest extent permitted by applicable law, Itinerama disclaims all express or implied warranties regarding the operation, availability, continuity, accuracy, reliability, or fitness of the App for a particular purpose.

Nothing in these Terms limits any non-waivable rights that users may have as consumers under applicable law.

15. Limitation of liability

To the fullest extent permitted by law, Itinerama shall not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from:

• use of or inability to use the App
• errors, interruptions, or service unavailability
• decisions made by the user based on information displayed in the App
• results generated through artificial intelligence
• acts, omissions, products, or services of third parties
• purchases, bookings, or contracts made with third parties outside the App

This limitation shall not apply where liability cannot be excluded or limited under applicable law.

16. Minors

Itinerama is not intended for children under 13 years of age.

If we detect that a child under 13 has provided personal data through the App, we may take reasonable measures to delete such data and, where appropriate, restrict or cancel the related account.

17. Changes to the terms

We may update these Terms of Use at any time.

When changes are material, we will try to inform users through the App or other appropriate means. The “Last updated” date will reflect the current version.

Where necessary, we may request a new express acceptance of the updated terms or policies.

18. Governing law and jurisdiction

These Terms shall be governed by the laws of Ireland, without prejudice to mandatory consumer protection provisions applicable in the user's jurisdiction.

Where permitted by law, any dispute shall be submitted to the competent courts of Ireland, without prejudice to any rights consumers may have under applicable law.
